Consumers have the option of choosing either Chapter 13 or Chapter 7 bankruptcy. Each filing has its pros and cons, but both will remain on your credit report for 10 years, which will limit your immediate access to any type of credit or loan. Declaring bankruptcy involves more than just filling out application forms. You’ll also need to attend meetings with creditors, trustees, attorneys and credit counselors.

If you have so much debt you can never repay it, then filling out application forms for debt management, debt settlement or debt consolidation companies may not help you. With debt management, you will meet with a credit counselor to find out how you can stretch your money, pay down high credit card balances, curb your spending habits and save more money each month. With debt settlement, you will agree to pay off your creditors at a reduced amount in one or two large lump sum payments. With debt consolidation, you will pay your creditors all that you owe but in one affordable monthly payment to a third party to simplify things. If these don’t seem like viable options to control your situation, then you will need Chapter 7 bankruptcy forms.

When we graduate high school, we feel we’re prepared for college. After all, we’ve studied, we’ve passed SATs, we’ve maintained sufficient grades, and we’ve filled out financial aid application forms and toured college campuses. And yet, we have no idea what sort of freedom and excitement college life holds for us. We may not even think about how much money we’re borrowing and spending with student loans. Whether we graduate or not, we’re still liable for paying off these loans, as unfair as it may seem. Some people think that they can declare bankruptcy student loan forgiveness and be done with it. However, it’s not so easy.

Quite often a lending institution, such as a bank or credit card company, will attempt to collect on bad debts on their own. Some companies will do their own in-house collections while others will hire some type of debt collection services company to handle their bad debt collection. Or, if the loan is secured with collateral, such as some type of vehicle, then collection agencies are often hired to collect the debt, or repossess the collateral. Most of the other types of debt collection involve attempting to collect the debt by contacting the debtor over the phone or through correspondence. There are times that a re-payment schedule may be offered in order to get the debt paid off.
